1. Agreement to Terms

By downloading, accessing, or using any PattyTech mobile applications ("Apps"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access our Apps. These Terms apply to all visitors, users, and others who access or use our Apps.

2. Eligibility

You must be at least 13 years of age to use our Apps. By using our Apps, you represent and warrant that you are at least 13 years old. If you are under 18, you must have your parent or guardian's permission to use our Apps. Users under 13 are strictly prohibited from using our Apps.

3. Account Registration and Security

Some features of our Apps may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Notify us immediately of any unauthorized use of your account
  • Not share your account credentials with third parties
  • Not create accounts using automated means or false pretenses

4. User Content and Conduct

Our Apps may allow you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for Content that you post to the Apps, including its legality, reliability, and appropriateness.

By posting Content, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Apps. You retain your rights to any Content you submit, post, or display on or through the Apps.

You agree not to:

  • Upload or share Content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy
  • Impersonate any person or entity
  • Upload Content that infringes any patent, trademark, copyright, or other proprietary rights
  • Upload malware, viruses, or any other malicious code
  • Use the Apps for any illegal or unauthorized purpose
  • Engage in any activity that interferes with or disrupts the Apps

5. In-App Purchases and Subscriptions

Our Apps may offer in-app purchases or subscription services. All purchases are final and non-refundable, except as required by law or as explicitly stated in our refund policy. Subscription services will automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions through your Apple App Store account settings.

Prices for in-app purchases and subscriptions are subject to change without notice. Payment will be charged to your Apple ID account at confirmation of purchase.

6. Intellectual Property Rights

The Apps and their original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of PattyTech and its licensors. The Apps are protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

PattyTech respects the intellectual property rights of others. If you believe that any Content violates your intellectual property rights, please contact us with:

  • A description of the copyrighted work claimed to be infringed
  • Identification of the allegedly infringing material
  • Your contact information
  • A statement of good faith belief that the use is unauthorized
  • A statement of accuracy and authorization to act on behalf of the copyright owner

7. Privacy and Data Protection

Your use of our Apps is also governed by our Privacy Policy, which describes how we collect, use, and share your information. By using our Apps, you consent to our collection and use of your data as outlined in the Privacy Policy. We are committed to protecting your privacy and handling your data in accordance with applicable data protection laws including GDPR and CCPA where applicable.

8. Third-Party Services and Links

Our Apps may contain links to third-party websites or services that are not owned or controlled by PattyTech. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that PattyTech shall not be responsible or liable for any damage or loss caused by or in connection with the use of any third-party services.

9. Disclaimers and Warranties

THE APPS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. PATTYTECH MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APPS WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PATTYTECH, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APPS.

IN NO EVENT SHALL PATTYTECH'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO PATTYTECH IN THE PAST TWELVE MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to defend, indemnify, and hold harmless PattyTech and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) resulting from or arising out of:

  • Your use and access of the Apps
  • Your violation of any term of these Terms
  • Your violation of any third-party right, including intellectual property rights
  • Any Content that you post or share through the Apps

12. Termination

We may terminate or suspend your account and bar access to the Apps immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Apps will immediately cease. If you wish to terminate your account, you may delete the Apps from your device and discontinue use.

All provisions of the Terms which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Any dispute arising from or relating to these Terms or the Apps shall first be attempted to be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that you may assert claims in small claims court if your claims qualify.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Apps after any revisions become effective, you agree to be bound by the revised terms.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Apps, and supersede and replace any prior agreements we might have had between us regarding the Apps.
